The session will focus on a significant case being heard by the Court on 11th and 12th February -a rare leapfrog appeal directly from the High Court. The case, CCC v Sheffield Teaching Hospitals NHS Foundation Trust (2023) EWHC 1770 (KB), involved Mr. Justice Ritchie, who was bound by the Court of Appeal decision in Croke v Wiseman (1982). That ruling held that lost years' earnings could not be recovered in the case of a child.
In this appeal, it will be argued that Croke was wrongly decided, and that a 9-year-old claimant with severe cerebral palsy should be entitled to recover loss of income for the period between the end of her reduced life expectancy and her uninjured life expectancy.
This promises to be an insightful discussion on a case that could have far-reaching implications.
